Terms of service
Last updated 28 September 2026
The basics
Business address: 6 Marine Crescent, Stourbridge, DY8 4XH.
These terms are between you and Kerbside Solutions. They cover our packages and custom solutions. We work with businesses, so by buying from us you confirm you're buying for your business, not as a private individual.
For a custom solution, your written plan sits alongside these terms. If the two ever disagree, your plan wins.
Packages
What you get
Each package includes what's described on our packages page on the day you buy. We set it up around your business and aim to have it live within three weeks of your kickoff chat, as long as we have what we need from you (content, logins and so on) in good time.
Paying
We agree your payment schedule before work starts. You can pay setup in full or pay the minimum upfront and spread the remaining setup cost over 12 monthly payments, alongside care. There is no added setup cost for spreading payments. Any penny rounding is adjusted in month 12; from month 13 you pay only the agreed care fee. If you cancel before your kickoff chat, we'll refund the setup fee in full.
Minimum term and notice
Packages have a three-month minimum. You can give 30 days' notice at any time, and your plan ends when the notice runs out or at the end of your third month, whichever is later. To cancel, just ring or email us. If you spread setup and leave before it is paid off, the remaining setup balance becomes due when your plan ends. This does not change your ownership of the build.
Bundles
Published bundle prices apply to the kits bought together. The website and client portal bundle has its own combined setup and monthly price. If you remove a kit, we agree the price for the remaining service before the next billing period.
The Website package
Up to five pages, with hosting, security, updates and quick changes included. A quick change is a small update that takes us under 30 minutes, like new text, photos, prices or opening hours. Anything bigger, we'll quote before we start.
Your website, project source code, domain, content and data belong to you. The monthly fee covers hosting, care and any agreed setup instalments; ownership does not depend on staying on a plan for 12 months.
Fair use
Packages include the texts, emails and AI drafting a small business normally needs. If your use goes well beyond that, we'll talk to you about a plan that fits before charging anything extra.
Custom solutions
We agree the scope, setup fee, monthly price and go-live date in your written plan before anything gets built. Setup starts from £495 and plans from £149 a month.
Term and leaving early
Custom solutions run on a 12-month term, because the monthly fee spreads the cost of building your setup. If you leave early, you pay off the remaining build cost, which is set out in your plan. Nothing more.
After 12 months
You choose:
- Keep improving. Stay on your plan for changes, upgrades and priority support.
- Keep the lights on. Move to Care at £39 a month. Your website stays hosted, secure and backed up, with no changes. Ongoing hosting and support for booking, quoting and automation tools are agreed separately.
- Take your website and go. Your website, content and domain are yours, and we'll hand them over properly.
Our price promise
Your price is locked for your term. After that, we'll give you at least 60 days' notice of any change, so you can decide what to do.
Your side of the deal
- Give us accurate information and the content we need, in good time.
- Only give us content you have the right to use.
- Use the tools lawfully, including the rules on marketing texts and emails.
- Check anything drafted for you, such as AI-drafted quotes, before it goes out.
- Keep your payment details up to date.
Who owns what
Your website or tool, its project source code, content and data belong to you. We record the transfer of rights in the work created for you in your signed project agreement. You can use, modify and move your build to another provider.
If you leave, we provide your project source code, a data export and the relevant access and handover information. Our hosting and maintenance end with your plan, so you will need to arrange replacement hosting and any required service accounts. Ending the care plan does not remove your ownership.
Third-party software, open-source components, fonts and services remain subject to their own licences and fees. We identify these dependencies at handover; they do not become your exclusive property.
Looking after your customers' data
When we run tools for you, we handle your customers' personal information on your behalf. You are the controller and we are your processor. We will:
- only use it to run your setup, following your instructions;
- make sure anyone who handles it is bound to keep it confidential;
- keep it secure with appropriate technical and organisational measures;
- only use the sub-processors listed in our privacy policy, tell you before adding a new one, and hold them to the same standards;
- help you respond to requests from your customers about their data, and with any data protection checks you need to do;
- tell you without undue delay if we become aware of a data breach affecting your customers;
- when your plan ends, give you a copy of the data if you ask within 30 days, then delete it unless the law says we must keep it;
- give you the information you need to show we're meeting these commitments.
You're responsible for having a lawful basis to collect your customers' details and for telling them how you use them.
Keeping things running
We keep your setup running, secure and backed up. Now and then we'll do planned maintenance, and we'll keep any downtime short. We can't be responsible for problems caused by services outside our control, such as internet outages or third-party platforms.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit. Otherwise, our total liability to you is limited to what you've paid us in the 12 months before the claim, and neither of us is liable for indirect losses or lost profits.
Ending things
Either of us can end the agreement straight away if the other seriously breaks these terms and doesn't put it right within 14 days of being asked. If a payment fails, we'll let you know and give you 14 days to sort it before we pause anything.
When your plan ends, we'll hand over what's yours as set out above.
Changes to these terms
We'll give you 30 days' notice of any changes. Changes never affect the price you've locked in for your current term.
The law
These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any disputes.
